In most cases, yes. If both parents have parental responsibility and there is no court order authorising travel, you should obtain written consent from the other parent before taking a child abroad. If a Child Arrangements Order states that the child "lives with" you, you can usually take the child out of the UK for up to 28 days without the other parent's consent, unless the order says otherwise. However, you must not undermine the child's time with the other parent under the order, and good practice is to share trip details in advance.

Answer

The 1980 Hague Convention on the Civil Aspects of International Child Abduction is an international treaty designed to secure the prompt return of children who have been wrongfully removed or retained across international borders. It applies between member countries and is based on the principle that decisions about a child's long-term arrangements should normally be made in the country of the child's habitual residence. Where the Convention applies, the courts in the country where the child has been taken generally deal with a summary return application rather than a full custody dispute.

What should I do if my child has already been taken abroad without my consent?

Answer

If your child has already been removed from the UK without consent or has not been returned after an agreed trip, you should seek urgent legal advice and contact the police. If the country involved is a signatory to the Hague Convention, an application can usually be made through the Central Authority for the child's return. If the country is not a member of the Hague Convention, different steps may be needed, often involving local lawyers abroad and possible applications to the High Court in England and Wales.
