What you need to know

Since 6th April 2022, divorce in England and Wales, under the Divorce, Dissolution and Separation Act 2020, removed fault from the process entirely. One spouse, or both jointly, files a divorce application containing a statement of irretrievable breakdown, and the court must treat that statement as conclusive evidence that the marriage has broken down – there is no need to prove blame or obtain the other party’s agreement. The application then progresses through two formal stages, the conditional order and the final order, with a statutory minimum of 26 weeks between application and the earliest point a final order can be granted.
