Agricultural and Rural Property in Banbury Divorces

Courts apply section 25 of the Matrimonial Causes Act 1973 to all assets, including agricultural land and farming businesses. The House of Lords confirmed in White v White [2000] UKHL 54 that there is no discrimination between the contribution of the person who ran the farm and the contribution of the spouse who managed the household, both carry equal legal weight.

In higher-value cases, the framework from Miller v Miller; McFarlane v McFarlane [2006] UKHL 24 applies: where assets significantly exceed the needs of both parties, sharing and compensation principles come into focus alongside needs.
